The B.C. Supreme Court’s ruling in Cowichan Tribes v. Canada recognized Aboriginal title over roughly 800 acres of public land in Richmond and affirmed fishing rights along the Fraser River’s south arm. The decision found that certain federal and municipal titles were “defective and invalid” because they infringed on Aboriginal title, suspending the order for 18 months to allow negotiations.
